SteadiBay is an online marketplace operated by SteadiParts GmbH, Buchenweg 10, 85232 Bergkirchen, Germany ("Operator"). These Terms govern the use of the platform and all transactions between users. By registering or using the platform, users agree to these Terms.
SteadiBay is a technical platform for facilitating purchase agreements between users. The Operator is not a buyer or seller, does not become a contracting party, and does not transfer possession or ownership. Contracts are concluded exclusively between buyer and seller.
Requirements: Minimum age 18 years and full legal capacity.
The Operator may suspend or delete accounts at any time.
Sellers are obligated to provide complete and truthful information, accurately describe the condition, and disclose any defects.
The Operator may remove listings at any time.
Upon completion of a purchase, a binding contract is formed exclusively between buyer and seller. The Operator is not part of this contract.
Payment processing is handled by the payment service provider Stripe.
The Operator does not hold customer funds and is not a payment service provider. No payment claims can be made against the Operator.
Payout occurs after confirmation by the buyer or after expiration of the period without complaint.
Outstanding charges under § 13a are offset against the seller's next payout. A payout never becomes negative and is never withheld in full: if it does not cover a charge, the charge remains open and is offset against a later payout. Outstanding charges are visible in the seller's account at any time.
The seller is obligated to ship promptly (usually within 3 business days), package securely, and use tracked shipping.
The buyer has 48 hours after receipt to confirm delivery or file a complaint. Without response, the payment is automatically released.
If a private seller sells a listing as a direct purchase, SteadiBay does not become a party to that purchase. Buyer and seller pay each other directly; neither the purchase price nor the shipping cost passes through a SteadiBay payment account. There is no escrow account, no dispute procedure through SteadiBay, and no reversal by us. Shipping and delivery information shown in the order overview is the seller's own statement and labelled as such; the exception is a delivery confirmed to us by our carrier-tracking provider, which we show as a fact. A direct purchase produces no review. This option is available only for sales between private individuals up to a purchase price of €2,500. The buyer may ask the seller for buyer protection on a single direct-purchase listing; if the seller accepts, § 10 applies to that purchase at the price agreed at the time of the request.
Complaints are possible for non-delivery, significant deviation, or defects.
Reversals are handled between buyer and seller. For justified complaints: return required, purchase price refunded.
If an item is no longer available, the seller may cancel the order from their account. The buyer is refunded in full without delay. Once the item has been shipped, cancellation is no longer possible; the rules on complaints apply instead.
A tiered platform fee is charged for successful transactions. The fee is automatically deducted and displayed before completion.
Changes to the fee structure are possible at any time and will be announced in advance.
If the seller cancels an order that has already been paid because the item is no longer available, we refund the buyer in full. The payment provider does not return the processing fee for that payment to us. We charge this actually incurred fee to the seller. It is shown before the cancellation and listed as an outstanding charge in the seller's account. Only the amount actually retained by the payment provider is charged; we do not levy a flat rate. The seller remains free to prove that no cost, or a substantially lower cost, was incurred. No claim arises where the seller is not responsible for the unavailability.
Sellers keep their listings current. If an item is sold outside SteadiBay, the seller marks the listing as sold without delay. As long as a listing is active, a buyer may assume the item is available.
The Operator may require verification at any time. This may be a prerequisite for using the platform and receiving payouts.
Measures: suspension, deletion, withholding of payouts.
Users retain rights to their content but grant the Operator usage rights. Users are responsible for their content.
The platform uses third-party providers. The Operator is not liable for their services.
Permanent availability is not guaranteed.
Liability is limited to the legally permissible extent.
The platform is provided "as is". No guarantees are made regarding functionality, availability, or error-free operation.
Users are responsible for customs, taxes, and import/export regulations.
No right of withdrawal against the Operator. A right of withdrawal may exist against commercial sellers.
Changes will be announced. Continued use constitutes acceptance.
§§ 27 to 30 apply to sales a commercial trader conducts through a shop on SteadiBay. They do not apply to sales between private individuals.
For trader sales the operator does not hold the purchase price.
Dispatch and delivery data are stored for every order, to the extent reported by the carrier, and made available to the trader and, in the event of a chargeback, to the payment service provider.
German law applies. Place of jurisdiction for merchants is Munich. If individual provisions are invalid, the remainder remains effective. The German version of these terms is authoritative; translations are provided for information only.
